1. Introduction

Welcome to Unexis Development (“we,” “us,” or “our”). By purchasing or accessing any digital product or service from our Tebex store (the “Store”), you (“you,” “the customer,” or “the user”) agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, you must not purchase or use any of our products.

These Terms constitute a legally binding agreement between you and Unexis Development regarding the purchase, download, installation, and use of digital assets, including but not limited to scripts and clothing items (“Products”).

2. Eligibility

By using our Store, you represent and warrant that:

You are at least 18 years old or have the consent of a parent or legal guardian.
You have the legal capacity to enter into binding contracts under applicable law.
You will use the Products only for lawful purposes and in compliance with these Terms and applicable laws.

3. Products and Licensing

3.1 License Grant:
Upon successful purchase, you are granted a non-exclusive, non-transferable, and revocable license to use the purchased Products for personal or server use within the FiveM framework or other applicable environments, subject to these Terms.

3.2 Restrictions:
You are strictly prohibited from:

Redistributing, reselling, leaking, or sharing any Product.
Claiming any Product as your own intellectual property.
Modifying or repackaging Products for resale or public distribution.
Using Products for any illegal or unauthorized purpose.

3.3 Ownership:
All Products remain the sole property of Unexis Development. Purchasing a Product does not transfer any ownership rights or intellectual property rights to you.

4. Payment and Pricing

4.1 Payment Processor:
All payments are handled securely through Tebex Limited, acting as the official reseller and merchant of record. By completing a purchase, you also agree to Tebex’s own Terms of Service and Privacy Policy.

4.2 Pricing:
All prices are listed in the currency shown on our Store and are subject to change without prior notice.

4.3 Taxes:
Prices may or may not include applicable taxes depending on your jurisdiction. Tebex may collect taxes on our behalf where legally required.

5. Refund Policy

All sales are final. Due to the nature of digital goods, no refunds, exchanges, or cancellations will be provided once a Product has been purchased or downloaded.
By purchasing from Unexis Development, you acknowledge and agree that you forfeit your right to any refund under South African Consumer Protection laws applicable to digital goods.

Refunds will only be considered in cases of duplicate payment errors or proven technical delivery failures directly attributable to our system.

6. Support

Support for Products is offered exclusively via our official Discord server.
We reserve the right to refuse support in cases of:

Breach of these Terms,
Use of leaked or modified versions of our Products,
Harassment or abuse of our staff or community members.

We do not guarantee response times or continuous support for discontinued Products.

7. Disclaimer of Warranties

All Products are provided “as is” and without any warranty of any kind, whether express or implied.
We make no guarantees regarding functionality, performance, compatibility, or error-free operation of our Products.

You assume full responsibility for any issues arising from the use of our Products, including but not limited to performance degradation, conflicts with third-party software, or server instability.

8. Limitation of Liability

To the maximum extent permitted by law, Unexis Development shall not be liable for any damages whatsoever, including but not limited to direct, indirect, incidental, consequential, or punitive damages arising from:

The use or inability to use our Products,
Data loss, downtime, or corruption,
Unauthorized access or modification of your files or data,
Any other matter relating to your purchase or use of our Products.

Our total liability, if any, shall not exceed the total amount paid by you for the Product in question.

9. Termination

We reserve the right to terminate or suspend your access to any Product at any time, without prior notice, if you violate these Terms or engage in any behavior deemed harmful to Unexis Development or its community.

Upon termination, all licenses granted to you will be revoked, and you must cease all use and distribution of the Product.

10. Intellectual Property

All Products, trademarks, trade names, graphics, and related materials are the intellectual property of Unexis Development.
Unauthorized use or reproduction of any part of our Products or branding will result in permanent license revocation and possible legal action.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles.
You agree to submit to the exclusive jurisdiction of the courts located within South Africa for any dispute arising out of or relating to these Terms or your use of our Products.

12. Amendments

Unexis Development reserves the right to modify or update these Terms at any time, without prior notice. Any changes will take effect immediately upon being published on our Tebex Store.

It is your responsibility to review these Terms periodically. Continued use or purchase of our Products after any changes constitutes acceptance of the revised Terms.
